Are Court Records Public in Polk County?

Birth and Death Records are maintained by the Polk County Clerk for events occurring within the county. Birth records are restricted for 75 years from the date of birth; death records are restricted for 25 years. Polk County Probate Court Records

Letters Testamentary and Letters of Administration are issued as originals only — no photocopies are made — and may only be received by the executor, administrator, guardian, or attorney of record. Each letter costs $2.00 under Local Government Code 118.061.
The Polk County Clerk's Office also offers a will safekeeping service. For a $16.00 fee, the office will hold an original will for preservation — a practical option for residents who want to ensure their testamentary documents are secured with the county. The Texas Estates Code, Chapter 252, governs the filing and safekeeping of wills.
Effective June 1, 2018, all guardianships in Texas must be registered with the Judicial Branch Certification Commission (JBCC). Attorneys handling guardianship matters should verify that their clients' representatives meet certification requirements before filing.
