Are Court Records Public in Henderson County?

Court records in Henderson County are presumed open to the public. Access to court case records in Texas is governed by common law, statutory law, and court rules rather than the Texas Public Information Act, which applies to executive-branch records. The key rule for judicial administrative records is Rule 12 of the Texas Rules of Judicial Administration, which establishes that judicial records are open for inspection and copying during regular business hours. For court case records specifically, public access is controlled by the Texas Rules of Civil Procedure (including Rule 76a regarding sealed court records), the Texas Rules of Criminal Procedure, and various statutes.

Under these provisions, most Henderson County case files — including docket sheets, pleadings, motions, judgments, and sentencing documents — can be inspected or copied by any member of the public. However, several categories of records are restricted or sealed:

  • Juvenile case files — Records involving minors are confidential under the Texas Family Code
  • Adoption records — Sealed upon finalization and accessible only with court authorization
  • Mental health commitment records — Protected from general public disclosure
  • Sealed cases — A court may seal records under Rule 76a of the Texas Rules of Civil Procedure when specific conditions are met
  • Sensitive personal information — Social Security numbers, financial account data, and medical records may be redacted from publicly available documents

Records connected to active investigations may also be temporarily withheld to avoid compromising ongoing legal proceedings. When a document contains both public and confidential information, the confidential portions are redacted before the record is released.

Anyone who believes they have been improperly denied access to a judicial record under Rule 12 may file a petition for review with the Administrative Director of the Texas Office of Court Administration within 30 days of the denial.
