The District Clerk’s Office handles records for District Court cases (felonies, high-value civil matters, family law cases, and contested probate). To request a record search performed by staff, submit a Search Request Form along with the applicable fee. To request copies, use the Copy/File Request form. Telephone requests for copies are not accepted. Allow three business days for processing.

Are Court Records Public in Fort Bend County?

Texas operates under a strong presumption of public access to government records. The Texas Public Information Act (Government Code Chapter 552) establishes that records held by government bodies—including courts, clerks, and law enforcement agencies—are generally open to the public unless a specific legal exception applies.

Fort Bend County court records follow this principle. Most case filings, docket entries, judgments, and orders in civil, criminal, family, and probate matters are publicly accessible through the clerk’s offices and the Odyssey Public Access portal. However, several important categories of records carry restrictions:

  • Juvenile records: Texas law generally prohibits disclosure of juvenile criminal records for misdemeanor offenses and certain non-felony matters. The Fort Bend County Juvenile Probation Department oversees the sealing of juvenile files under applicable statutes.
  • Sealed and expunged records: Courts may order records sealed through nondisclosure orders or expunction proceedings. Accessing sealed records in Fort Bend County requires filing a Motion and Order to Access Confidential/Sealed Records with the court.
  • Vital records: Under Section 552.115 of the Government Code, birth records remain confidential for 75 years from the date of birth, and death records are confidential for 25 years from the date of death. Fort Bend County Criminal Court Records

How to Obtain Civil Court Records

To search online, use the Odyssey Public Access portal and select “Civil, Family Case Records”. Civil and probate records are also available through the statewide re:SearchTX platform for registered users.

For copies of District Court civil records, submit a written request using the Copy/File Request form to the District Clerk’s Office. County-level civil records can be requested from the County Clerk. For Justice Court records, contact the specific precinct office directly. Fort Bend County Family Court Records

Family law matters in Fort Bend County—including divorce, child custody, child support, paternity, adoption, termination of parental rights, and protective orders—are heard primarily by the District Courts and the County Courts at Law. The District Clerk maintains records for family cases filed in District Court, while the County Clerk maintains records for those filed in County Courts at Law.

Access Restrictions

Because family court records frequently contain sensitive personal information—including details about children, financial accounts, and domestic violence—access to certain records or certified copies may be limited to the parties involved, their immediate family members, and authorized legal representatives. Unredacted or sealed portions of family case files generally require a court order to access.

Divorce Records

When a marriage is dissolved by a Fort Bend County District Court, the resulting records—including the petition, responses, agreements, and final decree—are maintained by the District Clerk. To request copies:

  1. Search for the case online through the Odyssey Public Access portal.
  2. Submit a written request to the District Clerk’s Office with the case number, names of the parties, and the approximate date of the divorce.
  3. Pay applicable copy fees. Certified copies may be restricted to the parties, immediate family, or legal representatives.

Statewide divorce records from 1968 onward are maintained by the DSHS Vital Statistics Section. Users can check the marriage-divorce index online. Verification letters (not certified decrees) cost $20 and require a completed application form, fee, and a photocopy of valid identification, sent to: DSHS – VSS, P.O. Box 12040, Austin, TX 78711-2040.

Marriage Records

The Fort Bend County Clerk issues marriage licenses and maintains marriage records for licenses issued within the county. Certified copies of marriage licenses cost $21, and keepsake marriage certificates cost $25 (note that keepsake certificates cannot be used for legal purposes). Birth and Death Records

While not strictly family court records, birth and death certificates are frequently needed in family law proceedings. The Fort Bend County Clerk has maintained birth records since 1838 and death records since 1903. Copies of birth certificates cost $23, and death certificates cost $21 from the County Clerk. These records are confidential under Government Code Section 552.115 (75 years for births, 25 years for deaths), and only eligible persons may obtain copies. Requests can be submitted through the County Clerk’s birth and death certificate page or mailed with an application form, fees, sworn statement, and photocopy of identification to the County Clerk at 301 Jackson Street, Richmond, TX 77469.

Fort Bend County Probate Court Records

Probate matters in Fort Bend County—including the administration of decedents’ estates, probate of wills, intestate succession, guardianships, trusts, conservatorships, and small estate affidavits—are handled primarily by the County Courts at Law. County Court at Law No. 3 serves as the principal probate court, hearing non-record matters (such as simple Letters Testamentary and Muniments of Title) on Wednesdays and record matters (such as Administrations and Heirships) on Thursdays. These hearings are typically held via Zoom at 11:00 AM. Contested probate matters and contested District Court cases may be scheduled on other days based on availability and urgency.
