Requesting Copies by Email or Mail

To obtain copies of documents from the District Clerk, email the District Clerk’s Office with your request details. The office will respond with the total fee and accept payment over the phone. Regular copies can be emailed directly. Certified copies require in-person pickup or mailing for an additional $2.00 postage fee.

Are Court Records Public in Comal County?

Under the Texas Public Information Act (Texas Government Code, Chapter 552), government records are presumed to be open to the public. Record custodians must treat all requesters equally, respond in a timely manner, and may not inquire about the purpose of a request. Court records in Comal County can be viewed at no charge at the relevant clerk’s office, and copies — whether plain, certified, or electronic — are available for purchase.

Comal County Criminal Court Records

Criminal jurisdiction in Comal County is split between two court levels. The five District Courts (207th, 22nd, 274th, 433rd, and 466th Judicial District Courts) hear felony cases, while the three County Courts at Law handle Class A and B misdemeanor cases. Arrest Records and Jail Information

Comal County Civil Court Records

Civil cases in Comal County fall under the concurrent jurisdiction of the District Courts and the County Courts at Law. The District Court has original jurisdiction over civil matters involving $200 or more, land title disputes, and cases exceeding the County Courts’ limits. Property Records

Divorce Records

Certified copies of divorce decrees are available only from the clerk of the court where the decree was originally filed — either the District Clerk or the County Court at Law Clerk. Divorce records can also be searched through the Civil, Family Case Records on the Judicial Record Search page.

Marriage Records

The County Clerk’s Office issues marriage licenses and maintains marriage records. Licenses are available without appointment from 8:00 AM to 11:30 AM and 1:00 PM to 4:30 PM. Applicants must provide a current, valid government-issued photo ID. Birth certificates for events within the past 75 years are restricted to the registrant, immediate family, and legal representatives. Applications are available for birth certificates and death certificates.

Comal County Probate Court Records
