The county's court system includes five district courts (the 149th, 239th, 300th, 412th, and 461st), four county courts at law, and eight justice of the peace courts spread across four precincts. Two separate clerk offices manage most court records: the District Clerk handles filings from the district courts—felonies, major civil matters, family law, and juvenile cases—while the County Clerk maintains records from the county courts at law (misdemeanor criminal, civil, probate, and juvenile matters) and also keeps vital records and real property instruments. How to Look Up a Court Case in Brazoria County?

Whether you need a quick docket check or certified copies of filed documents, Brazoria County offers several ways to track down court case information.

Online Case Search

Start with the Court Records Inquiry portal, which pulls together records from both the District Clerk and County Clerk systems. The portal has separate search modules for criminal records, civil/family/probate cases, court calendars, and jail records. When searching by case number, always add an asterisk (*) at the end of the number to make sure you get complete results.

Online case searches are free and show basic information such as case number, parties, filing date, court assignment, and docket entries. Document images are generally not available for viewing or download through the portal.

The District Clerk accepts attorney checks, cashier's checks, money orders, credit cards (service fee applies), and cash (accepted until 4:45 p.m.). The County Clerk accepts similar payment methods; credit card payments also carry a processing fee.

Are Court Records Public in Brazoria County?

Court records in Brazoria County are generally presumed open to the public. That presumption comes from Rule 76a of the Texas Rules of Civil Procedure, which says court records are accessible to the general public and can only be sealed after a specific showing of necessity. While the judiciary is exempt from the Texas Public Information Act (Texas Government Code Chapter 552), Rule 76a imposes its own public-access standards on court filings.

A record can be sealed only if a party demonstrates that a specific, serious, and substantial interest clearly outweighs the presumption of openness, that no less restrictive means are available, and that any sealing order is narrowly drawn. Anyone can intervene to oppose a sealing motion.

Certain categories of records are restricted or confidential under Texas law:

  • Juvenile records: Generally confidential under Texas Family Code Title 3; access is limited to law enforcement, attorneys of record, the juvenile and their parents, and other authorized entities. The County Clerk's juvenile records page outlines these restrictions. Juveniles may petition to have their records sealed.
  • Sealed cases: Records sealed by court order under Rule 76a or specific statutes are not available for public inspection.
  • Active investigation files: Records tied to ongoing criminal investigations may be withheld.
  • Sensitive personal and financial information: Social Security numbers, financial account numbers, and similar identifiers are routinely redacted from public filings.

Brazoria County Criminal Court Records

Criminal matters in Brazoria County are split between the district courts and the county courts at law. Felony cases are prosecuted in the five district courts, and the District Clerk maintains all related records. Adult misdemeanor criminal cases are heard in the county courts at law, with the County Clerk holding those records.

Brazoria County Civil Court Records

Civil cases in Brazoria County are divided between the district courts and county courts at law based on the dollar amount at stake. District courts have jurisdiction over civil matters exceeding $200,000 and share concurrent jurisdiction with the county courts at law for claims between $500 and $200,000. The county courts at law also handle most eminent domain proceedings.

The District Clerk holds civil case records from the five district courts. The County Clerk holds civil filings from the four county courts at law. Justice of the peace courts handle small claims and civil matters within their statutory monetary limits, and those records are kept at the respective JP court locations.

Copy Fees

Standard County Clerk copy fees for civil records are $1.00 per page for non-certified copies and $5.00 per document plus $1.00 per page for certified copies. The District Clerk's fee schedule, detailed in the earlier section, applies to district court civil records.

Brazoria County Family Court Records

Family law proceedings in Brazoria County are primarily heard by the 300th District Court and the 461st District Court. The county courts at law also have jurisdiction over certain family matters. Cases in these courts include divorce, annulment, child custody, child support, modification of conservatorship, adoption, and protective orders.

Accessing Family Court Records

Records involving child welfare proceedings and juvenile matters are subject to confidentiality restrictions under Texas Family Code Title 3 and are generally not available to the public.

Divorce Records

Divorce decrees and related documents are kept by the District Clerk. You can get copies online, in person, or by mail using the same procedures and fees described for district court records. The Texas Department of State Health Services, Vital Statistics maintains an index of divorces from 1968 onward and can provide divorce verification letters by mail, in person, or online.

Marriage Records

Marriage licenses issued in Brazoria County are filed with and maintained by the County Clerk. The marriage license page on the County Clerk's website explains how to get copies. Birth and Death Records

The County Clerk issues certified copies of birth certificates ($23.00 each) and death certificates ($21.00 for the first copy; $4.00 for each additional copy purchased at the same time). Access to birth records is limited to the registrant, parents, legal guardians, managing conservators, adult children, and grandparents; a valid government-issued photo ID is required. Death records become public 25 years after the date of death. You can request vital records in person at any County Clerk location, by mail using the Birth/Death Application form, or by email with credit card payment. The Texas DSHS Vital Statistics office also processes statewide birth and death certificate requests.

Brazoria County Probate Court Records

Probate jurisdiction in Brazoria County rests with the county courts at law, with County Court at Law No. 1 designated as the statutory probate court. Matters handled include will probate, estate administration, guardianship of incapacitated persons, conservatorships, heirship determinations, and trust disputes.

Requesting Copies

You can get copies of probate documents in person at the County Clerk's office at 237 E. Locust, Suite 102, Angleton, TX 77515, or by email or mail. If you don't have the case number, a $5.00 name search fee applies. Copy fees follow the standard County Clerk schedule: $1.00 per page for non-certified copies, and $5.00 per document plus $1.00 per page for certified copies. Email requesters must process payment through the Clerk's verified payment provider using Bureau Code 3433402 and include the payment confirmation number in their email to cclerkpublic@brazoriacountytx.gov.

Probate records are generally open to public inspection. Guardianship files, however, may contain medical or financial information subject to redaction, and any record sealed by court order will not be available without specific judicial authorization. Always verify all fees against the County Clerk's current fee schedule and the District Clerk's published rates, as amounts are subject to legislative or administrative changes.
